Vehicle Rental Agreement
Last updated·October 12, 2026
1. Agreement
This Vehicle Rental Agreement ("Agreement") is between you, the person booking the rental ("you" or "Renter"), and Playa Cruisers, Inc. ("Playa Cruisers," "we," or "us"). It applies to every Playa Cruisers vehicle you rent, from pickup until the vehicle is checked back in by a Playa Cruisers representative (the "Rental Period").
You accept this Agreement when you check the rental agreement box at checkout. Together with our Rental Cancellation Policy, the safety briefing and inspection you sign at pickup, and our Terms of Use, it forms the complete terms of your rental. If this Agreement conflicts with the Terms of Use on a rental matter, this Agreement controls.
Agreement version: 2026-10-12
2. Drivers
- Every driver must be at least 25 years old and hold a valid, unexpired driver's license.
- You must provide your driver's license and proof of current personal auto insurance in your account before pickup. We may cancel a rental, subject to the Cancellation Policy, if you do not.
- Only you and drivers approved by Playa Cruisers at pickup may operate the vehicle. You are responsible for anyone you allow to drive or ride in it.
3. The vehicle and where you may drive it
Playa Cruisers vehicles are Neighborhood Electric Vehicles (NEVs), also called low-speed vehicles, with a top speed of about 25 mph. California law limits where they may be driven. You agree that:
- You will drive only on public roads with a posted speed limit of 35 mph or less, and never on Pacific Coast Highway (PCH), highways, freeways, or any road posted above 35 mph.
- You will not drive on The Strand, bike paths, sidewalks, pedestrian walkways, beaches, or any area not designated for motor vehicle traffic.
- Every occupant will wear a seat belt at all times, and you will not carry more passengers than there are seat belts or let anyone ride outside the passenger compartment.
- No driver will operate the vehicle under the influence of alcohol, cannabis, or any drug that impairs driving.
- You will obey all traffic laws, posted signs, parking rules, and local ordinances, and will not use a handheld phone while driving.
- You will not use the vehicle for racing, towing, off-road driving, carrying goods for hire, rideshare or delivery services, or any unlawful purpose, and will not smoke or vape in it.
4. Pickup, mileage, charging, and return
- At pickup you will complete a safety briefing and a vehicle inspection with a Playa Cruisers representative. Report any existing damage then so it is recorded.
- Each rental day includes 35 miles. Additional miles are charged at $0.50 per mile.
- Return the vehicle to the agreed location by the scheduled return time. Late returns are charged at your rental plan's extra-hour rate for each hour or partial hour late.
- Plan your trips so you can return before the battery drops to 20%. Do not charge the vehicle yourself or attempt any repair. If the battery runs low, park safely and contact us.
5. Security deposit
At pickup we place an authorization hold on your card as a security deposit, currently $300 unless a different amount is shown to you before the hold is placed. The hold is released after check-in when no charges are owed. If charges are owed under this Agreement, we may apply the deposit toward them and will release any remainder.
6. Your responsibility for the vehicle and charges
During the Rental Period you are responsible for the vehicle and its keys, and you agree to pay, and authorize us to charge the card on file for:
- Loss of or damage to the vehicle, its keys, or its equipment, including theft, up to the reasonable cost of repair or, if the vehicle cannot be repaired, its fair market value, except for normal wear and damage that we recorded before your rental.
- Mileage overage and late return charges described in Section 4.
- The reasonable actual cost of cleaning beyond normal use, removing smoke or odors, and replacing lost keys.
- Parking and traffic citations, tolls, towing, and impound fees incurred during the Rental Period, plus any reasonable costs we incur to process them.
We will give you an itemized description of any damage or additional charges, with supporting photos or receipts where available, before or when we charge you.
7. Accidents, breakdowns, and theft
- If anyone is injured or there is an immediate safety risk, call 911 first.
- Report any accident, damage, breakdown, or theft to us right away, and in any case within 24 hours. Report theft and any accident involving injury or another vehicle to the police.
- Do not admit fault or arrange repairs yourself. Cooperate with us, the police, and any insurer investigating the incident.
8. Insurance
You must carry personal auto liability insurance that applies to your use of the vehicle. To the extent permitted by law, your insurance is primary for any claim arising from the Rental Period. Playa Cruisers does not sell rental insurance or a damage waiver.
9. Assumption of risk
YOU UNDERSTAND THAT NEVS ARE SMALL, OPEN, LOW-SPEED VEHICLES THAT OFFER LESS PROTECTION THAN A STANDARD CAR, AND THAT DRIVING OR RIDING IN ONE ON PUBLIC ROADS CARRIES RISKS, INCLUDING COLLISIONS WITH OTHER VEHICLES, PEDESTRIANS, OR OBJECTS, AND SERIOUS INJURY OR DEATH. YOU VOLUNTARILY ACCEPT THESE RISKS FOR YOURSELF AND ON BEHALF OF YOUR PASSENGERS.
10. Release and indemnity
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE PLAYA CRUISERS AND ITS OFFICERS, EMPLOYEES, AND AGENTS FROM CLAIMS FOR INJURY, DEATH, OR PROPERTY LOSS ARISING FROM YOUR RENTAL OR USE OF THE VEHICLE, AND YOU AGREE TO INDEMNIFY AND DEFEND THEM AGAINST CLAIMS BY OTHERS, INCLUDING YOUR PASSENGERS, ARISING FROM YOUR OR YOUR DRIVERS' USE OF THE VEHICLE OR BREACH OF THIS AGREEMENT.
This release does not apply to claims caused by Playa Cruisers' gross negligence, fraud, willful misconduct, or violation of law, or to any other liability that cannot be waived under California law.
11. Ending a rental early
If you or another driver breaks Section 2 or Section 3, or uses the vehicle in a way that endangers people or property, we may end the rental immediately and recover the vehicle wherever it is located. No refund is due for the unused time, and you remain responsible for charges under Section 6.
12. Payment, cancellation, and disputes
Your trip total is charged when you book. Cancellations and refunds are governed by the Rental Cancellation Policy. To dispute a charge, contact us first at the address below. Disputes not resolved informally are handled under the dispute resolution and governing law sections of our Terms of Use.
13. General
If any part of this Agreement is held unenforceable, the rest remains in effect. We may update this Agreement for future bookings; the version you accepted at checkout applies to your rental. California law governs this Agreement.
